Welcome to Savvy Headshot. These Terms of Service (“Terms”) govern your access to and use of the Savvy Headshot website, applications, and AI portrait generation service (collectively, the “Service”) operated by Orz, LLC (“we,” “us,” or “our”). By creating an account, uploading photos, or otherwise using the Service, you agree to be bound by these Terms.
If you do not agree, do not use the Service.
1. The Service
Savvy Headshot transforms selfie photographs you upload into AI-generated professional portrait images (“Headshots”). To produce Headshots that depict you, the Service trains a private, fine-tuned AI model from your uploaded photos (“Per-User Model”); that Per-User Model, together with Google’s image-generation models, produces your Headshots. See our Privacy Policy for what we do and do not do with your photos and your Per-User Model.
2. Eligibility & Accounts
You must be at least 18 years old to use the Service. By using the Service you represent that you meet this requirement and have full legal capacity to enter into these Terms. You are responsible for safeguarding the credentials associated with your account and for all activity that occurs under it. You agree to notify us promptly at support@savvyheadshot.com if you suspect any unauthorised use of your account.
3. Communications
By creating an account, you agree to receive transactional and account-related communications from us by email, including sign-in codes, photos-ready notifications, deletion warnings, receipts, security alerts, and material changes to these Terms or our Privacy Policy. These communications are necessary to operate the Service and you may not opt out of them while your account is active.
Any promotional or marketing emails are separately opt-in or include an unsubscribe link in every message. Unsubscribing from marketing does not affect transactional communications.
4. Photos You Upload
When you upload selfies or other photos to the Service (“Input Photos”), you represent and warrant that:
- You own all rights in the Input Photos, or have obtained all necessary rights, licences, and consents from every identifiable person depicted in them.
- The Input Photos do not depict minors (persons under 18 years of age).
- The Input Photos do not depict any public figure, celebrity, politician, or any other person whose likeness is protected by publicity, personality, or similar rights in any jurisdiction, unless that person is you and you hold those rights.
- The Input Photos do not contain nudity, sexually explicit content, depictions of violence, hate symbols, or any material that is illegal in the United States or your country of residence.
- The Input Photos do not infringe any third party’s intellectual property, privacy, or contractual rights.
You retain ownership of your Input Photos. You grant us a limited, worldwide, royalty-free licence to host, process, analyse, and transform your Input Photos solely for the purpose of (a) training your Per-User Model, (b) generating your Headshots, and (c) operating, securing, and supporting the Service. This licence terminates when your Input Photos are deleted under our retention schedule.
5. Per-User Model & Generated Headshots
The Per-User Model trained from your Input Photos is created and used solely to generate Headshots that depict you. We do not use the Per-User Model to generate content for any other user, and we do not share, license, sell, or contribute the Per-User Model or your Input Photos to Google or any other third party for use in training their models. The Per-User Model is deleted on the same 30-day schedule as your Input Photos and Headshots — see our Privacy Policy for full details.
Subject to your compliance with these Terms and your payment of any applicable fees, you own the Headshots generated for you. You may use them for any lawful personal or commercial purpose, including LinkedIn profiles, marketing materials, speaker bios, and printed media.
You acknowledge that AI-generated images may include subtle imperfections (in the rendering of hands, fine accessories, text, or background detail) and that small variations across a generated set are inherent to the technology.
6. Acceptable Use
You agree not to:
- Use the Service to impersonate another person, create deepfakes, or generate misleading depictions of any identifiable individual other than yourself (where you hold the necessary rights).
- Use the Service to harass, defame, threaten, or harm any person.
- Use the Service to generate content that is unlawful, sexually explicit, hateful, or that exploits or endangers minors.
- Reverse engineer, decompile, or attempt to extract the source code, weights, or model parameters of the Service.
- Use any automated means (bots, scrapers, headless browsers) to interact with the Service except for publicly documented APIs.
- Attempt to circumvent any payment, watermark, or rate-limit mechanism — including downloading or screen-capturing watermarked previews and removing the watermark.
- Resell, redistribute, sublicense, or provide access to the Service to third parties.
- Interfere with or disrupt the Service, the servers or networks that host it, or any other user’s enjoyment of it.
7. Pricing & Payment
Pricing for our packages is shown at the point of purchase. Payments are processed by Stripe, Inc.; you authorise the charges by completing checkout. All amounts are in U.S. dollars unless otherwise stated, and Stripe may convert and display the equivalent in your local currency at checkout.
Some plans include a fixed quantity of generation credits (“Credits”) usable for editing, regeneration, or upscaling. Credits expire six (6) months after purchase, are non-transferable, and are not redeemable for cash.
8. Refunds
We offer a seven (7) day no-questions-asked refund window from the time of purchase. See our Refund Policy for details and the request process. Outside that window, refunds are at our sole discretion and will generally be considered only where a technical failure prevented you from receiving your Headshots and we were unable to remedy it.
9. Termination
We may suspend or terminate your access to the Service if you breach these Terms, abuse the Service, attempt to defraud us or other users, or use the Service for any purpose prohibited by Section 6 (Acceptable Use). Where practical we will give you prior notice and an opportunity to cure; for serious or repeated violations we may suspend immediately.
You may terminate your account at any time by emailing support@savvyheadshot.com; we will delete your account and associated data in accordance with our Privacy Policy. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnification) will survive.
10. Intellectual Property
The Service — including the website, the Savvy Headshot name and logo, the prompts and pre-trained components that power the Service, the catalogue of outfits and backdrops, the site copy, the visual design, and all other content not contributed by you — is owned by us or our licensors and is protected by copyright, trademark, trade-secret, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in any of the foregoing, except for the limited right to use the Service in accordance with these Terms.
11. Links to Other Web Sites
The Service may contain links to third-party websites or services that are not owned or controlled by us, including Stripe (for payments), Google (for AI image generation), Cloudflare, Supabase, and Resend. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. You acknowledge and agree that we are not liable for any damage or loss caused by your use of any such third-party content, goods, or services.
12. Error Reporting & Feedback
You may choose to send us error reports, suggestions, ideas, or other feedback about the Service (“Feedback”). You agree that we may use Feedback for any purpose, commercial or otherwise, without compensation or attribution to you, and that we owe you no confidentiality obligation with respect to it. To the extent any Feedback you provide is protected by intellectual property rights, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, perpetual, irrevocable licence to use it.
13. DMCA / Copyright Complaints
We respect the intellectual property rights of others and expect users of the Service to do the same. If you believe content on the Service infringes your copyright, please send a written notice to support@savvyheadshot.com that includes:
- A physical or electronic signature of the person authorised to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it (such as the URL or other specific location on the Service).
- Your name, postal address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorised to act on behalf of the copyright owner.
Misrepresentations in a copyright notice may subject you to liability for damages.
14. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE GENERATED HEADSHOTS WILL MEET YOUR EXPECTATIONS.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL Orz, LLC BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
16. Indemnification
You agree to indemnify, defend, and hold harmless Orz, LLC and its officers, employees, and agents from and against any claim, demand, loss, or damages, including reasonable attorneys’ fees, arising out of or related to (a) your Input Photos, (b) your use of the Headshots, (c) your violation of these Terms, or (d) your violation of any third-party right (including intellectual property, publicity, or privacy rights).
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes will be communicated by email to the address on your account before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
18. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising from or relating to the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
19. Waiver & Severability
No failure or delay by us to enforce any right or provision of these Terms will operate as a waiver of that right or provision. If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect.
20. Acknowledgement
BY USING THE SERVICE OR OTHER SERVICES PROVIDED BY US, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND OUR PRIVACY POLICY AND AGREE TO BE BOUND BY THEM.
